Our platform supports all Talents and in order to be able to provide our services, we need to make sure to protect our “App” and “Website” against potential abusers. We need you to read, understand and accept our agreement so we can build a foundation based on trust. This service is operated by TalentBegins, a limited liability company registered in England and Wales with company number 11730295.

Acceptance of Terms of Use Agreement

Please read these terms and conditions (the “Terms”) carefully. By accessing and using our App available on Android and iOS devices and any content and features therein including our Services, you indicate your acceptance of these Terms and the Privacy Policy any other notices, guidelines and rules published by us on our Services from time to time (each of which is incorporated into the Terms by this reference).

• If you do not accept these Terms please do not access and/or use our Services.
• TalentBegins LTD and references in this document to “us,” “our,” and “we” refer to TalentBegins LTD and Talentbegins.com.
• We may update these Terms at any time. Please review the Terms regularly to ensure you are aware of any changes. Your continued access to and/or use of our Services after changes have been made to the Terms indicates your agreement to be legally bound by the updated and/or amended Terms.

1. App Use and Your Rights

The App is owned and operated by TalentBegins. All intellectual property rights, including copyright, in the content displayed on the App (“Content”) belong to TalentBegins. All rights are hereby reserved.

2. Eligibility

When you access the App, you undertake:

• You are over 12 years of age to create an account on TalentBegins.
• You will not allow any other person to use the App under your name, nor will you in using the Site, pretend you are someone else or seek to disguise your identity.

Subject to the undertakings you give in these Terms, we grant you a non-exclusive, non-transferable right and license to use the App and any software on our server, which is enabled, by your use of the App, solely to access the platform and Services.

3. Account Creation

In order to use our services, you need to create an account, which gives you access to all the features that you can enjoy as a user-member. The prerequisites for creating an account are:

New users can create a new account using their mobile number or email. They can also use their social media accounts like Google account to login and use our services. Please do not use our services if you object to using a third party social logins. Please note this is mandatory and you can create an account as normal using your phone number or email too.

In order to be able to use the TalentBegins App, one has to be at least 12 years of age. Nevertheless, with the permission of a parent or a legal guardian anyone with talent is allowed to use and experience this unique App.

It is prohibited and against our Terms to use other user’s login and pretend that it is yours. Failure to adhering to these terms may result in permanent suspension of your account. Talent Begins reserves the right to not grant you any future access to the App.

4. Our Rights

Failure by you to comply with these Terms constitutes a material breach of these Terms and may result in us take all or any of the following actions:

• Immediate, temporary or permanent withdrawal of your right to use our Site
• Issue of a warning to you
• Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; and Further legal action against you.

5. TalentBegins Content

The App and the Content may only be used for your personal, non-commercial use.

Except as set out above, you agree not to download, copy, reproduce, modify, store, archive, show in public, redistribute or commercially exploit in any way any part of the Content without the prior written permission of TalentBegins. You agree not to use the Content or the App for any illegal or improper purpose, nor for any purpose, which might infringe the rights of others, or which might harass or cause inconvenience or distress to any person.

You also agree to abide by all copyright notices and restrictions attached to the Content and not to remove or alter any such notice or restriction or alter the Content in any way.

You acknowledge and agree that we may generate revenues, increase goodwill or otherwise increase our value from your use of the Services, including, by way of example and not limitation, through the sale of advertising, sponsorships, promotions, usage data and except as specifically permitted by us in these Terms or in another agreement you enter into with us, you will have no right to share in any such revenue, goodwill or value whatsoever.

6. Using the App, the content and your obligation

• When you register with us, you undertake that the details you provide us with are true, accurate and complete and that you will tell us promptly of any changes to these details. To ascertain how we process your personal data, please click on our Privacy Statement in the App.
• Part of the information you are required to provide to register with us is a Password. This is generated by you. You are responsible for ensuring that any Password (or any substitute Password) you use to register or to access your Account (after registration) is kept confidential, only used by you and is not used by or disclosed to others.
• New users can create a new account using their mobile number or email. They can also use their social media accounts like Google account to login and use our services.
• You are also responsible for: (i) all transactions or activities carried out using your Account and password; and (ii) ensuring that when you access the Account that the system, you use to access the Account is secure, is not left unattended unless you have fully exited the Account and that your password is not retrievable from the system by others.
• You are responsible for notifying us if you know or suspect that your Account or password might be known to a third party. If you fail to do so, you will be liable and fully responsible until you notify us.
• Have permission to legally use the App in your country of residence.

Waiver of Rights to User Content
By posting User Content to or through the Services, you waive any rights to prior inspection or approval of any marketing or promotional materials related to such User Content. You also waive any and all rights of privacy, publicity, or any other rights of a similar nature in connection with your User Content, or any portion thereof. To the extent any moral rights are not transferable or assignable, you hereby waive and agree never to assert any and all moral rights, or to support, maintain or permit any action based on any moral rights that you may have in or with respect to any User Content you Post to or through the Services.

We also have the right to disclose your identity to any third party who is claiming that any User Content posted or uploaded by you to our Services constitutes a violation of their intellectual property rights, or of their right to privacy.

We, or authorized third parties, reserve the right to remove, disallow, block or delete any posting within 24 hours and ejecting the user who provided the offending content on our platform if, in our opinion, your post does not comply with the content standards set out at “Your Access to and Use of Our Services” above. In addition, we have the right – but not the obligation – in our sole discretion to remove, disallow, block or delete any User Content (i) that we consider to violate these Terms, or (ii) in response to complaints from other users or third parties, with or without notice and without any liability to you. As a result, we recommend that you save copies of any User Content that you post to the Services on your personal device(s) in the event that you want to ensure that you have permanent access to copies of such User Content. We do not guarantee the accuracy, integrity, appropriateness or quality of any User Content, and under no circumstances will we be liable in any way for any User Content.

You control whether your User Content is made publicly available on the Services to all other users of the Services or only available to people you approve. To restrict access to your User Content, you should select the privacy setting available within the Platform.

We accept no liability in respect of any content submitted by users and published by us or by authorized third parties.

7. User Content

TalentBegins does not claim ownership of any Content that you post on or through the Service. TalentBegins offers users to share content via our App. All user content belongs to the user/talent who posted the content and is stored on our servers.

Users are prohibited to post content or items in inappropriate categories or areas on our App, Sites and services.

8. Reproduction of the App Content

The App and the Content are the copyright of Talent Begins. If you wish to re-publish, re-distribute or exploit the Content in any way you should address a request for permission to TalentBegins by Email to compliance@talentbegins.com TalentBegins cannot guarantee that any such permission would be forthcoming or on what terms.

9. Third Party Links

Third parties are permitted to link to stories within the TalentBegins App, using the URL and quoting the headline and the source.

A third party must ensure that nothing on its own App suggests or could be understood to imply that any part of the App is part of its own App unless the third party has obtained the prior written approval of Talent Begins.

TalentBegins reserves the right to withdraw any permission without explanation or notice if in its sole judgment use of such links is excessive or inappropriate. TalentBegins also reserves the right to change the location and nature of files within the App without explanation or notice; it is the responsibility of the third party to check and update links as necessary.

10. Modifications to the Service and Prices

Prices for our services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. We are also in line with the App Store and Google Market change policy terms.

11. Trademarks and Intellectual Property

TalentBegins is the Registered Trademark of TalentBegins and the content of this site are part of its intellectual property. You acknowledge that the Services are protected by copyright, trademark, and other laws of the United Kingdom and foreign countries. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Services.

12. Limited Liability and Disclaimer

TalentBegins obtains the Content from a wide range of sources and it includes facts, views, opinions and information likely to be of interest to users of the App.

TalentBegins does not endorse or accept any responsibility for any views, advice, recommendations or opinions expressed on any App to which we link. You should note that any contact or arrangements made between you and any third party named on the App or any third party App linked from it is at your own risk, and Talent Begins accepts no liability.

The Content should only be used for your general information and use and not by way of specific recommendation or advice, as every individual’s circumstances are different. Before taking any action or decision based in whole or in part on the Content, you should always make your own independent checks of any information that is important in making such decisions or taking such action.

TalentBegins does not give any warranties in respect of the Content or the App, freedom from viruses or other contamination or that the App is compatible with any computer systems, software and browsers. All implied warranties or duties are excluded save if and to the extent that they may not lawfully be excluded.

TalentBegins shall not be liable for any claims, losses, injuries, penalties, damages, costs or expenses arising from the use of, or inability to use the App or Content or from any action taken, or omitted to be taken, as a result of using the App or its Content.

13. Changes to the Terms and Conditions

TalentBegins reserves the right to make changes to any part of the App and to add to or change these at any time. Any new features or tools that are added to the current App shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our App. It is your responsibility to check this page periodically for changes. Your continued use of or access to the App following the posting of any changes constitutes acceptance of those changes.

14. Severability

If any part of these Terms becomes illegal, invalid, unenforceable, or prohibited in any respect under any applicable law or regulation, such provision or part thereof will be deemed to not form part of the contract between us. The legality, validity or enforceability of the remainder of these Terms will remain in full force and effect.

15. Legal

By accessing the App you agree to accept that these Terms are governed by and construed in accordance with the laws of England. You also accept the exclusive jurisdiction of the English Courts in relation to any dispute that may arise in connection with these Terms or your use of the App or arising in any way from the Content.
